Terms of Service

These Terms of Service (“Terms”) govern your use of the website operated by Nomad Eats LLC (“Nomad Eats,” “we,” “us”), a food truck in Spring, TX, and the orders and requests you place with us. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Menu, prices and hours

We work to keep our menu, prices, photos and hours accurate, but they may change without notice, items may sell out, and dishes may vary slightly from their photos. Prices are shown before applicable sales tax. If a price on the Site differs from the price at the truck or on our online ordering page at the time of your order, the price at the time of ordering applies. Prices on third-party delivery apps are set separately and are typically higher to cover their fees. We may change our hours or close for weather, events or other circumstances.

2. Online orders and payment

Online orders are placed and paid for through Clover, our point-of-sale provider, and are also subject to Clover’s terms. An order is accepted when we confirm it. Delivery fees, delivery areas and estimated times are shown at checkout. Orders placed through DoorDash, Uber Eats or Grubhub are subject to those services’ terms, and delivery is their responsibility.

If there is a problem with your order, please contact us as soon as possible at 346-872-9992 so we can help. Issues with app orders should be reported through the app you used.

3. Allergies and dietary information

All of our meat is Halal. Our kitchen is small and shared, and we cannot guarantee that any item is free from allergens. Allergen and ingredient information on the Site is a guide, not a guarantee. If you have a food allergy or dietary requirement, tell us at the window before you order.

4. Catering and events

Submitting a request through our Catering page is an inquiry, not a booking. A catering order or truck booking is confirmed only when we confirm it with you directly. Pricing, deposits, cancellation terms and other event details are agreed in writing at that time.

5. Use of the Site

You agree to use the Site only for lawful purposes. You may not submit false or misleading requests, attempt to disrupt or gain unauthorized access to the Site, or use automated means to collect its content.

6. Intellectual property

The Nomad Eats name, logo, photographs, text and design of the Site are owned by Nomad Eats LLC or used with permission, and are protected by law. You may share links to our pages, but you may not copy or reuse our content for commercial purposes without our written permission.

7. Third-party sites and services

The Site links to services we do not control, such as Clover, Google Maps, social media and delivery apps. We are not responsible for their content, availability or practices, and your use of them is governed by their own terms.

8. Disclaimers

The Site is provided “as is” and “as available,” without warranties of any kind, whether express or implied. We do not guarantee that the Site will be uninterrupted, error-free or that its information is always current.

9. Limitation of liability

To the fullest extent permitted by law, Nomad Eats LLC will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Site. Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules.

11. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above shows when they last changed. Continuing to use the Site after a change means you accept the updated Terms.
